The federal classification of marijuana as a List I controlled substance has been a major hurdle for the legal cannabis industry at the state level for years. Patients who use medical marijuana are often at risk of federal reprisals for engaging in an activity that is considered legal by their home states and that aims to improve their health and quality of life. As a result, most federal agencies that are required to comply with federal policies tend to withhold certain benefits from those who use state legal cannabis.
Michigan’s Attorney General Dana Nessel doesn’t think this should be the norm. In a briefing prepared by her office, she argued that employers cannot use cannabis use as a reason to exclude their employees from receiving unemployment benefits.
