Fired For Smoking Weed? MI AG Says You Should Still Get Unemploym

Because YOU (Michigan) voted to “legalize it,” the effects of that vote could now protect you if you get fired and register as unemployed.
And Michigan attorney general Dana Nessel is for it.
You can hire and fire whatever you want, but you can’t deny it.
Let’s remember a few things about the state of Michigan. It is an “at will” state. What does that mean?
In general, an employer can fire an employee for good, bad, or no reason. An employee can contest his dismissal if it is based on a discriminatory act that is specially protected by law. (michigan.gov)
So the law is on their side when it comes to firing you. For whatever reason. Even if they tested you on drugs to get the job and later fired you for thinking you were high or whatever.
As long as it wasn’t discriminatory, they can do it for any reason. So “at will”.
Now comes the part where they can’t do ANYTHING based on you and your legal off-clock marijuana use.
First off, it’s legal because the state of Michigan voted to legalize it.
What you do in your free time is up to you.
So if weed has been legalized and you use this legal product in your spare time, even if you get fired for whatever reason, your employer cannot and must not deny you unemployment benefits as a result.

… it should be common sense that engaging in a legal activity that does not interfere with a person’s job would be a poor basis for denying a person the need for unemployment benefits. This applies to the off-duty and legal recreational use of marijuana as well as to the medical use of marijuana or any other legal activity. In 2018, the people of Michigan legalized the recreational use of marijuana. (michigan.gov)
